Rules, Zones and Fines for SUV Car Rental in Spain

Speed limits are set by road type, not by the car you drive, and an SUV follows exactly the same table as a hatchback. On an autopista or autovía the limit is 120 km/h for cars, motorcycles and campervans up to 3,500 kg; on an ordinary two-way road outside towns it is 90 km/h, though the road authority may raise that to 100 km/h. In town the default is 30 km/h where there is one lane in each direction, 20 km/h on streets where pavement and roadway form a single platform, and 50 km/h where there are two or more lanes each way. Bus and taxi lanes do not count towards that tally.

Speed limits and what a fine costs

Speeding is graded in steps of 100, 300, 400, 500 and 600 EUR, with penalty points from zero to six attached to the higher bands; the 600 EUR tier is classified as muy grave. Driving more than 60 km/h over the limit in town, or more than 80 km/h over it outside town, stops being an administrative fine and becomes a criminal offence. Fines are graded leve (up to 100 EUR, no points), grave (200 EUR) and muy grave (500 EUR and always points), and paying within 20 calendar days cuts the amount by 50%.

Alcohol, phones, children and the environmental sticker

• Alcohol: the general limit is 0,25 mg/l of breath, dropping to 0,15 mg/l for drivers in their first two years and for professionals; above 0,60 mg/l it is a crime, and any trace of drugs is grounds for a sanction on its own.
• Phone: 200 EUR and three to six points, and six points if the handset was held in the hand.
• Seat belts and child seats: 200 EUR and four points; child restraints (SRI) are compulsory up to 135 cm in height, and the driver answers for a child travelling without one.
• Distintivo ambiental: the DGT environmental sticker — 0, ECO, C or B — is displayed on the windscreen and decides whether you may enter a Zona de Bajas Emisiones (ZBE).

Winter tyres are not a seasonal requirement here: there is no national rule forcing them in the cold months, and DGT imposes the restriction point by point, with signs and overhead boards on named roads when snow affects traffic. If you are heading into the mountains, check the boards before you leave rather than after — the requirement appears and disappears with the weather, and a set of chains in the boot costs less than turning back.

Documents, Insurance and the Rental Agreement for SUV Hire in Spain

What you can drive on and what the agreement has to spell out are two different things — here is both, as Spanish law and our own paperwork put them.

Driving licence rules for SUV hire

• EU/EEA licences: valid here as they are, with nothing added, for as long as the licence itself has not expired — including licences from Iceland, Liechtenstein and Norway.
• Licences from outside the EU/EEA: accepted for driving if the licence is in force and the holder is old enough for the equivalent category here; residents have six months from taking up ordinary residence to exchange it, and DGT advises getting an International Driving Permit before you travel.
• Licences not written in Spanish: valid either with an official certified translation into Spanish, or when issued on the model of Annex 9 of the Geneva Convention or Annex 6 of the Vienna Convention; an IDP is the practical alternative to a translation.
• International Driving Permit: a supporting document only — it is shown together with your passport and your national licence, never on its own; it runs for one year and carries 16 pages in Spanish, German, English, French, Italian, Portuguese, Arabic and Russian.

Which card is taken for the deposit, the minimum age and the young-driver surcharge are set out in the agreement and agreed when booking, not by law — bring those questions to the manager before the booking is fixed, because they change the total, not the car.

Insurance that comes with the car, and the options on top

Every car legally on a Spanish road carries Seguro Obligatorio de Responsabilidad Civil, and it is part of the hire by default — it covers injury and property damage caused to third parties up to 70,000,000 EUR per incident for personal injury and 15,000,000 EUR for property, under Real Decreto Legislativo 8/2004, article 4.2 as amended by Ley 5/2025. It does not cover the driver or the car itself. CDW takes collision damage off your account except for the franquicia, the excess, which is printed in the agreement whether or not you buy it down; THW does the same for theft and vandalism; SCDW and SPCDW buy the excess down partly or fully, and STHW and SPTHW do it on the theft side. WWI covers glass and tyres separately, and the deposit is a preautorización blocked on a credit card — its amount, like the excess, is set out in the agreement.

What to check before you drive away

Spanish consumer rules require every scratch and dent to be written into the agreement or the inspection sheet before you leave, signed by both sides, with a copy for you — otherwise the damage is put on your account. If the model you booked is not there, you can ask for another car at no extra cost, even a class above; if you are given a lower class, the price has to come down; if the car does not match the agreed terms, the booking can be cancelled and the prepayment returned. The declared price must include all compulsory charges — the obligatory third-party cover, the young-driver surcharge and the rest. Keep that signed sheet with you for the whole trip: it is the only record that separates your damage from the damage that was already there.

If your route mixes motorway with unpaved access roads, the middle of the range (a hybrid Tucson or Sportage at €50) usually does more for you than either extreme.
